1.1 Welcome to nicecontent.io (the "Platform"). The Platform is owned and operated by Nice Content AG, a company incorporated under the laws of Switzerland ("we", "us", "our", "Nice Content").
1.2 These Terms and Conditions ("Terms") govern your ("you", "your", "User") access to and use of the Platform and the services provided by Nice Content. Please read these Terms carefully before using the Platform.
1.3 By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Platform.
2. SERVICES
2.1 The Platform sells online prepaid or subscription products for which you will receive a balance to spend on AI products, mainly content generation.
2.2 If you have a subscription, you will have a contingent that will refill at the end of each month.
2.3 We sell through PayPal and Stripe.
3. SUBSCRIPTIONS AND PAYMENTS
3.1 Subscriptions need to be cancelled prior to renewal. Annual subscriptions need to be cancelled prior to subscription renewal.
3.2 We do not reimburse balance nor can we reimburse subscriptions that have been used. It is a digital item that cannot be subject to be given back.
3.3 We do reimburse balance used in the case of technical failure of the Platform.
4. USER OBLIGATIONS
4.1 You agree to comply with all applicable laws and regulations in connection with your use of the Platform and to not use our Platform to create illegal content.
4.2 You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

5. INTELLECTUAL PROPERTY RIGHTS
5.1 All intellectual property rights in the Platform and the content provided by Nice Content are owned by us or our licensors.
5.2 You are granted a limited, revocable, non-exclusive, non-transferable right to use the Platform.
5.3 AI Content created under a paid subscription is your property, you may use it for your personal & commercial use.
5.4 AI Content created under the free trial is property of Nice Content, you may use it for personal & commercial use but you need to mention: "created with nicecontent.io"
6. DISCLAIMERS AND LIMITATION OF LIABILITY
6.1 The Platform and the content provided by Nice Content are provided on an "as is" and "as available" basis without any warranties of any kind.
6.2 We do not warrant that the Platform or the content provided by Nice Content will be uninterrupted, error-free, or free of otherwise harmful components.
6.3 We will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising from your use of the Platform or the content provided by Nice Content.
7. INDEMNIFICATION
7.1 You agree to indemnify, defend and hold harmless Nice Content, its officers, directors, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account.
8. GOVERNING LAW AND JURISDICTION
8.1 These Terms are governed by the laws of Switzerland and you agree to submit to the exclusive jurisdiction of the Swiss courts.
9. CHANGES TO THESE TERMS
9.1 We reserve the right to change these Terms at any time. Any changes will be posted on this page and will take effect immediately upon posting.
